Custodial Violence Alleged During Ramzan: Petition Filed Before Telangana Human Rights Commission Against Raidurgam Police”:
A petition has been submitted to the Telangana State Human Rights Commission (TSHRC) seeking an inquiry and strict action against the Inspector of Police and other police personnel of Raidurgam Police Station under Cyberabad Commissionerate for allegedly assaulting three Muslim youths inside the police station.
The petition was filed by Mohammed Fazal Ur Rahman Akeef (20 years), resident of Chanchalguda, Hyderabad, alleging custodial violence and violation of fundamental human rights.
According to the petition, the incident occurred on 8th March at around 12:20 AM near T-Hub, opposite Niloufer Café when a police personnel allegedly approached Akeef and his friend Abdul Rahman, slapped him without provocation and forcibly snatched the keys of his two-wheeler.
When Akeef questioned the police personnel and opened his mobile phone camera, another policeman allegedly snatched his mobile phone and both youths were taken to Raidurgam Police Station and asked to return in the morning.
Later on the same day, Mohammed Fazal Ur Rahman Akeef along with Syed Areeb and Mohammed Sohail visited the police station as instructed and were asked to wait for the Inspector of Police, Raidurgam Police Station.
While waiting in the open area of the police station premises, Akeef noticed his two-wheeler parked there and began taking photographs of the vehicle and the police station board to inform his family. At that moment, a police personnel allegedly slapped Mohammed Sohail and snatched his mobile phone.
Soon after, the Inspector of Police Raidurgam Police Station arrived and called all three youths into his office where several police personnel were already present. After checking their Aadhaar cards and other documents, the police personnel allegedly started brutally beating all three youths.
The petition states that the youths were assaulted with hands, beaten with tyre chappals and kicked with shoes while lying on the floor, and were also allegedly abused in filthy language referring to their religion.
The complaint further alleges that when the youths informed the police personnel that they were fasting during the holy month of Ramzan, the assault became even more severe.
The petition also highlighted that Syed Areeb had recently undergone tumor surgery on his head and was already suffering from a fractured shoulder and hand, yet despite showing the fresh surgery stitches and injuries, the police personnel allegedly continued the assault.
The petition submitted before the Human Rights Commission states that the incident amounts to custodial violence and a serious violation of fundamental rights guaranteed under Articles 14, 21 and 22 of the Constitution of India.
It also cites the Supreme Court guidelines in the landmark judgments of DK Basu vs State of West Bengal (1997) and Joginder Kumar vs State of Uttar Pradesh (1994), which lay down safeguards against custodial violence and arbitrary arrest.
The petition further states that the alleged acts of the police personnel attract provisions under the Indian Penal Code including Sections 323 (voluntarily causing hurt), 341 (wrongful restraint), 342 (wrongful confinement), 504 (intentional insult) and 506 (criminal intimidation).
The petitioner has requested the Telangana State Human Rights Commission to take cognizance of the incident, order an independent inquiry into the matter and direct strict disciplinary and legal action against the police personnel responsible for the assault.
The petition has also requested the Commission to ensure protection of the fundamental rights of the victims and recommend appropriate compensation for the physical injuries and mental trauma suffered by the youths.
The matter has raised serious concerns regarding custodial violence and the conduct of police personnel, and the petitioner has expressed hope that the Human Rights Commission will intervene to ensure justice and accountability.
