Section 35 of the Constitution of the Republic of South Africa,1996...provides for the right of an accused person to appoint a legal representative of his or her choice at his or her expenses.
The section further states that where an accused cannot afford their own legal representation the accused must be afforded legal representation at state expenses if substantial injustice would otherwise result.
This places a great burden on the legal aid profession and state funds, which the Legal Aid Board administers
