What the WTO couldn’t stop… the US Supreme Court just did.
US Supreme Court Blocks Trump’s Tariffs
In a 6–3 ruling, the Supreme Court of the United States held that former President Donald Trump cannot impose sweeping global tariffs under the International Emergency Economic Powers Act (IEEPA).
📌 Why did the Court intervene?
Because the Constitution assigns tariff powers to Congress, not the President — making this a major assertion of separation of powers.
After the setback, the administration shifted strategy and invoked the Trade Act of 1974, imposing a 10% global tariff under Section 122.
⚠️ But there’s a limitation:
• Import surcharges capped at 15%
• Valid only for 150 days
• Intended mainly for balance-of-payments crises
🌍 Why this matters for India
Uncertainty over tariff levels could affect:
• Export competitiveness
• Trade negotiations
• Global supply chains
📘 Bigger takeaway:
When multilateral institutions struggle, domestic constitutional courts can still check executive power in global trade politics.
