1) Eligibility of seller to sell a property i.e. plot, house, shop, agricultural land, etc.
Who can sell the property?
1. Original owner,
2. Power of attorney/Mukhtar Nama,
3. Guardian having permission to sell the property,
4. Any person appointed by an Authority/Court for selling/auction a property.
2) Copies of which documents are required from above eligible persons?
Fresh Fard-e-Malkiet,
Registry/Sale Deed, (Eligibility 1)
Copy of power of attorney/Mukhtar Nama (Eligibility 2)
Copy of Guardian Certificate and Document of permission to sell the property, (Eligibility 3).
Copy of publication/auction of property (Eligibility 4).
3) Verification of Documents?
All copies of documents shall be verified from concerned offices.
4) Reputation and character of Seller?
It is necessary to check the reputation and character of Seller.
5) Buying property on the basis of sale agreement?
Sometimes, property dealers/investor entered into sale agreement with original owner by paying him 5%, 10% or 25% cash as earnest money. Such sale agreement is alarming for buyer because property dealer/investor has no right to sell the property on the basis of such sale agreement.
6) 04 Types of property can never sale?
Property against Stay Order issued by court.
Property entered as surety in court.
Property attach by court due to any reason.
Property pledged/mortgage by any bank
7) Property visit and its measurement?
8) Payment to seller through bank, instead of cash or to any other person?
9) Taking Power of attorney/Mukhtarnama instead of Registry?
10) Proof of transfer of property as per law, documents required?
