Elder abuse does not always look dramatic. Many cases begin with good intentions. Like a family member stepping in to “help” an aging parent who is showing signs of cognitive decline, dementia, or Alzheimer’s.

⚖️ In this case:

➡️ An elderly father begins losing mental capacity
➡️ The family agrees that one child should move in to help
➡️ A power of attorney is put in place with family consent
➡️ The arrangement appears reasonable and respectful

Over time, however, something changes…

🛑 After the adult child moves in, money begins to be taken… not for the care of the father, but for:

Vehicles
Gifts
Personal expenses
Lifestyle upgrades

The defense is familiar: “Dad wanted me to have it.”

The legal problem is simple but critical: Once mental capacity is lost, consent no longer exists.

Capacity loss is not always a single moment. It happens on a spectrum.

But in this case, it became clear very early that the father no longer had the legal ability to authorize financial transfers.

💵 Every dollar taken after that point constitutes elder abuse and exploitation under Florida law!

It was only after the father passed away that the family uncovered what had happened over several years.
