Jeff Mitchel discusses an important question - what time limit does one have to file an injury claim. Those limits exist all across Nova Scotia as well as in other parts of Canada. Filing your injury claim at court and discussing it with an insurer are two very different things.
Normally you have exactly 2 years from the day of the accident to file. You or your lawyer are solely responsible to make sure your claim is filed on time.
However there are 3 notable exceptions to the context of injury claims:
1) You didn't have details of the other driver or you think they might be uninsured; then there would be 1 year limitation to file your claim.
2) Child injury victims - if you were a minor at the time you were injured than the time limitation does not run against you until you become an adult.
3)Filing a claim against your municipality - you only have 1 year and you must also give them 30 days notice, so practically you have 11 months.
