Definition of a probated will.
A probated will is the will of somebody who has passed away and has gone through the court process to prove its validity.
That means that the court or judge has reviewed the will and has determined that yes, it was executed and technically signed properly with the correct number of witnesses and so forth, and yes, the person who was making the will at that time was mentally competent, was not under any undue influence or pressure and forced or tricked into signing the document, and therefore the document accurately reflects who should be the executor, who should be the guardians or trustees, and which heirs receive what assets.
And once the will has been probated, the effect of that is that all the terms and wishes in the will have become binding and have legal force of law.
