The bench observed that enforcing such a law could discourage employers from hiring women, reinforce gender stereotypes, create a perception of inferiority, and harm women's career growth and equal opportunities. The Court left the matter as a policy decision for the government, noting existing voluntary or state-level initiatives in places like Odisha, Karnataka, and Kerala. Cuttack-based lawyer Bibhuti Choudhury clarified the ruling's rationale, emphasizing potential unintended consequences on women's employability.
