Question: In a condominium, if a member defaults payment of maintenance dues, what is the legal recourse for collection? Can the Managing Committee impose restrictions on the usage of its premises for such defaulters e.g. parking of cars, entry of cars, garbage collection etc. What are the advantages and disadvantages of owning a Condominium over a Cooperative Housing Society in Pune?
Answer: If both the liabilities agreed, please refer to the civil court and file a civil summary suit. If the owner does not agreed, please file another civil summary suit at the civil court and asked for attachment and auction of that particular property.
