Hi there my name is John Palley I am a probate attorney here in California. Our main office is in Sacramento California. That is where I am today. Our other office is in Roseville California. We do probates throughout the state of California. Today I just wanted to give you a short video about the California probate process to give you what you can expect in the coming months.

First of all hire a GOOD probate attorney. I think it's important that the person be a Certified Specialist in probate, trust and estate law. I am. That means we took a second bar exam only in these areas of law. Several other of the attorneys in my office also have this certification. I think it's important as it shows dedication but it also shows experience and knowledge that is needed to navigate the probate process. Don't be fooled by a paralegal or a new attorney or someone who dabbles in probate. Get yourself a good attorney. Whether it's me or someone else that's your choice but makes sure it's someone experienced.

Probate is... first of all probate comes into a play when a person dies, with assets not in a living trust, that exceed one hundred and fifty thousand dollars in gross value. That is when you have a full probate. There are situations with less than hundred and fifty thousand dollars... there are some other exceptions. Certainly I can help you with all those. Today I just want to talk about a full probate. It is 7 months start to finish. It can be longer. It will not be shorter than 7 months. During that time we are going to get you, or someone else, appointed as administrator or executor of the estate. We are then going to gather all the assets, determine the liabilities, determine the taxes, pay all those creditors and liabilities, make sure we have the right heirs or beneficiaries lined up to receive that money, then we are going to file our final petition to get that money and get the distributions approved and distribute the money. Obviously I am simplifying the process greatly. The point is it is 7 months. During the 7 months there are a number of hurdles that we jump over. As an attorney that has done over 500 probates in California (I have been an attorney since 1994) I look ahead to that next hurdle. I want to keep us on track for 7 months. I don't want this to turn into a two year probate. I want it to be a 7 month probate. I am looking ahead, I am looking to that next thing, I am looking to the next hurdle, I am looking down the track to get to the finish line at 7 months. I think I am very good at it. I am very efficient.

Again, I have done a lot of these so I know what needs to be done. I know on a video I can't give you all the information so certainly set an appointment with me.
