A deposition is a pretrial question and answer session that takes place in our office. Actually in our conference room. You see, when you bring a lawsuit seeking money as a form of compensation for your injuries, the attorney who represents the people you sued will have a chance to question you before your case ever gets to trial.

Lawyers call this a deposition. It's also called an examination before trial. It's sworn testimony. The answers you give to those questions form the basis of your pretrial testimony and carry the same exact weight as if you're testifying at trial in front of a jury.

But your pretrial deposition happens in our office. There's no jury there. There's no judge there either.

Here are two tips that will help you during your pretrial testimony:
(1) NEVER EVER LIE and
(2) NEVER GET INTO VERBAL ARGUMENTS WITH THE DEFENSE LAWYER

Those two tips will help you greatly when you're questioned by the defense.

You must always tell the truth when testifying.
If you don't, the defense will learn the truth and then show the jury at trial that you are not believable.

The reason you don't argue with the defense lawyer is because that's not your job. That's your lawyer's job. Your job is to describe factually what happened to you and what injuries you suffered as a result of your doctors' carelessness.
