India’s Parliament has passed a landmark piece of legislation that could reshape the country’s energy future. The Sustainable Harnessing and Advancement of Nuclear Energy for Transforming India — or SHANTI Bill — has been approved by both houses, ending an era where the civil nuclear power sector was almost exclusively controlled by the state.

For the first time in India’s history, private companies will be allowed to build, operate, and invest in nuclear power plants. Under the SHANTI Bill, firms will be able to apply for licences to set up and run nuclear facilities, subject to stringent regulation and oversight from the government’s nuclear safety authorities.

This is not just a policy tweak — it is a legal overhaul. The SHANTI Bill repeals outdated laws such as the Atomic Energy Act of 1962 and the Civil Liability for Nuclear Damage Act of 2010, replacing them with a modern regulatory framework designed for today’s energy challenges. That framework makes room for private sector and even foreign investment, up to set limits, while aiming to strengthen safety and liability guidelines.

The government’s stated goal is ambitious: scaling India’s nuclear power capacity to 100 gigawatts by 2047 to meet rising electricity demand and support the transition to cleaner energy. Nuclear power, with 25 reactors already operating at about 8.8 GW capacity, has so far accounted for a small slice of India’s energy mix. Opening the sector is meant to accelerate expansion, attract capital, bring advanced technologies like small modular reactors, and reduce dependence on fossil fuel generation.

But the Bill has not sailed through without controversy. Opposition lawmakers and safety advocates have warned that allowing private players into such a sensitive sector could dilute safety standards and weaken accountability in the event of an accident. Some critics also argue that regulatory oversight must be watertight before private firms take on nuclear operations.

Despite the pushback, the government has defended the reform, saying it retains strong safety safeguards and that opening India’s nuclear sector will boost energy security, create jobs, and support climate goals.
