In a recent judgment, the Himachal Pradesh High Court’s Single Bench declared the Employees’ Provident Fund Organisation’s (EPFO) pro-rata method for calculating higher pensions as “unjust” and directed the EPFO to rectify the discrepancy. The method, which splits pensionable service into pre- and post-September 2014 periods, has led to significant reductions in pension amounts for many retirees.

However, following an appeal by the EPFO, a Division Bench has granted a stay on the Single Bench’s order. This interim relief reinstates the pro-rata calculation method, pending further judicial review, and temporarily favors the EPFO’s position
