Centre Opposes Creamy Layer For SC-ST Quota, Says Discrimination Goes Beyond Economic Status

The Centre has opposed applying the ‘creamy layer’ criterion to affluent members of SC and ST communities seeking reservation benefits in jobs and education. Telling the Supreme Court that discrimination goes beyond economic conditions, the government said reservation addresses historical marginalisation and promotes equal opportunity. The response follows the Supreme Court's 2024 verdict allowing sub-categorisation within SC communities. The Centre stressed that any income-based changes require a comprehensive empirical study and can only be made by Parliament. It also cited Articles 341 and 342 on Parliament's exclusive power over SC and ST lists.
