In this video, we will discuss the CSPA age calculation method and derivative children who get aged out during visa processing.
Child Status Protection Act (CSPA) was enacted in order to keep immigrant families and children intact despite family-based and employment-based waiting processes which can go all the way to 10 to 23 years.
Before CSPA, once a child turned 21 years of age, he or she was considered as "aged-out" and was no longer eligible to immigrate with their parents.
CSPA freezes the age of children when their priority date becomes current in chart A (Final Action Chart) but not before that.
Congress recognized that many children were aging out due to large USCIS processing backlogs, so it enacted the Child Status Protection Act (CSPA) to protect children from aging out. The CSPA act went into effect on August 6th, 2002.
