Mamata Banerjee has refused to resign as the West Bengal CM a day after the election results on May 4. The BJP defeated TMC by winning 207 in the 294-member assembly. She claimed the BJP conspired with the Election Commission to win. Mamata lost to BJP's Suvendu Adhikari in her bastion of Bhabanipur.

Mamata would have to step down since the governor of a state can dismiss the CM as per Constitutional norms. The term of the 17th West Bengal Legislative Assembly ends on May 7. Banerjee's chief ministership ends with the term. If an election is challenged in court, it will be unprecedented
