After the Civil War, the former Confederate states were not automatically restored to the Union.
Congress imposed conditions.
The most important condition was ratification of the Fourteenth Amendment.
That raises a difficult constitutional question:
If acceptance of the 14th Amendment was the legal basis for readmission after the Civil War, what happens when political movements openly repudiate that amendment today?
In this episode of The Rule of Law Brief, I examine:
• Reconstruction and the Reconstruction Acts
• Birthright citizenship
• Equal protection and due process
• Congressional authority over admission and readmission of states
• The constitutional legacy of the Civil War
• Whether modern political attacks on the 14th Amendment reopen unresolved constitutional questions
This is probably the most provocative constitutional argument I’ve explored on the channel so far.
Do you think the Fourteenth Amendment is the true constitutional foundation of modern America?
