A residential lease refers to a contract between a landlord and one or more tenants for the rental of a property for predominantly domestic or home use.
A commercial lease refers to a contract between a landlord and one or more tenants for the rental of a property for a predominantly commercial, or business, use. When these lines are blurred, particularly as home-offices increase in popularity, it is more important than ever to distinguish between residential and commercial leases.
In Florida, for example, Chapter 83 of the Florida Statutes covers both residential and commercial tenancies, but each type of lease is subject to its own set of laws and regulations.
Typically, commercial leases are less regulated in order to allow the market to dictate the terms of the lease, whereas residential leases tend to have more restrictions on minimum standards and terms for public policy reasons and to ensure that tenants in poor bargaining positions aren’t taken full advantage of.
