One last variation on the issue of having your job offer pulled before your first day of work.
❌ The probation clause won’t apply because probation is geared toward checking your suitability for the job. If you haven’t started working, then you haven’t had a chance to prove your suitability.
❌ Unliked yesterday’s video, the without cause termination clause doesn’t apply either. That’s because the clause only says what happens AFTER you complete probation. In this case, you haven’t even started probation.
✅ In cases like this, your common law notice entitlements apply, meaning a few weeks’ to a few months’ pay. The total 💰 you’re owed will depend on:
1️⃣ your age
2️⃣ your job
3️⃣ the availability of similar jobs in the market, and
4️⃣ if you were recruited.
