Hi. I'm Brandon Naidu, and I'm a criminal defense attorney here in San Diego, California. Want to talk to members of the military for just a few minutes here. If you've been accused of a crime, whether or not it occurred on base or out in town, whether it was a misdemeanor, whether it was a felony, you already know that you're going to be facing some pretty harsh consequences and it's usually like a double edged sword. Your command's going to find out about this and there's going to be repercussions just based on the accusation alone before you've been convicted, before you've maybe even had your day in court.
Then depending on the nature of the crime, you could be prosecuted either on base through a Court Marshall, an NJP, or in the federal courts, or they could turn it over to the local state court for prosecution. So it's very important that if you've been accused of a crime, whether or not this is a simple misdemeanor that happened out in town, say a DUI, or if this was a major felony, like one of our clients who was a member of the military and was accused of statutory rape, it's very important that you give us a call.
What we were able to do for this particular client was we worked with NCIS for about a year and a half throughout the entire investigation. And at the conclusion of that investigation, we were able to convince them to turn the prosecution over to the state court. Why is that important? It gave us a lot more flexibility in being able to negotiate what the repercussions were, what the consequences and what the plea deal would look like as opposed to going through the federal system. And as a result, we were able to achieve simple probation for our client.
