At the end of an L&I claim, an assessment has to be made as to whether or not the injured worker has suffered a permanent partial disability. Special rules apply. The department requires that permanent partial disability be determined using national guidelines. In Washington state, we use the AMA meaning the American Medical Association’s “Guides to the Evaluation of Permanent Partial Impairment 5th Edition”. Very often, the condition that's being assessed doesn't even appear within the guidelines and that can often cause the Department of Labor & Industries to say that no permanent partial disability exists. Hiring an attorney can assure the injured worker that they have the best possibility of getting the highest PPD outcome at the end of their case.
