Alabama Menacing Law Explained by a Lawyer Who It Happened to.
Years ago, when I was headed to my first day at law school, a black van came barreling down the road careening into my lane. He was about to hit me. I laid on the horn to let him know I was there. The van cut across three more lanes of traffic and pulled rapidly to the side of the road far ahead of me. As I passed, the driver leaned out the window pointing a shotgun at me.
What crime was committed? This was menacing under Alabama law because the guy in the van was intentionally placing me in fear of imminent serious physical injury. That’s what menacing is. It’s intensely placing, or attempting to place, another person in fear of imminent serious physical injury.
The fellow who pointed the shotgun at me never got caught.
Had he been, his maximum punishment would be up to six months in jail and a $3000 fine.
