First, the most important thing you need to know is that the court will only return the bail after the case is finished. This means the case must be completed, the charges dismissed, or the court must issue a final judgment. If there is an appeal, the bail money may stay with the court until the appeal is over.

Second, the person who paid the bail, also called the guarantor, must request the refund. You cannot get the money back automatically.

You will need to prepare some documents, such as the original bail receipt, your ID or passport, your bank account details, and sometimes a copy of the final court order. If your lawyer submits the request, a power of attorney is also required.

Next, you must submit the request at the same court where the bail was deposited. The court will check whether the accused followed all bail conditions and appeared in court as required.

If everything is correct, the court will approve the refund. Normally, the process takes about two to six weeks, and the money will be transferred to your bank account or paid by cheque.

One important warning — if the accused fails to appear in court, the bail money can be forfeited. This means you may lose the entire amount.
