Описание: Justice Dipankar Datta’s powerful observation in the Supreme Court may become one of the defining constitutional lines of India’s electoral jurisprudence:

“It is not sufficient that the Election Commission is independent; it must also appear to be independent.”

What followed was a high-voltage constitutional debate on the future of the Election Commission’s appointment process, the legacy of the Anoop Baranwal judgment, Article 14, separation of powers, and the possibility of a Constitution Bench reference under Article 145(3).

Attorney General R. Venkataramani argued that Anoop Baranwal is now “a matter of history” after Parliament enacted the 2023 law. But Justice Datta pushed back sharply, questioning whether institutional independence can survive if the ruling government dominates the selection panel.

And then came the question that could define the entire case:

“Why should it necessarily be a Minister from the Cabinet?”

The courtroom discussion went far beyond one statute. It touched the very foundation of public confidence in free and fair elections, judicial restraint, parliamentary supremacy, and constitutional accountability.

If referred to a 5-judge Constitution Bench, this case could reshape the framework governing Election Commission appointments for the next decade — impacting every major election from 2027 onward.
