The U.S. Supreme Court stated in the Tinker decision that neither students nor teachers “shed their constitutional rights to freedom of speech or expression at the schoolhouse gate.” In this video, I’ll first introduce what kind of educators’ speech is protected and what is not. I’ll first introduce the Pickering v. Board of Education (1968). This case was about teachers’ speech on issues of public importance. The U.S. Supreme court's decision declared that public employees do not relinquish all of their free speech rights while working for the government.
I’ll then introduce the standards used in the Pickering decision. The standards came from the case New York Times Co. v. Sullivan (1964). In this case, the U.S. Supreme Court held that the freedom of speech protections in the First Amendment restrict the ability of American public officials to sue for defamation.
The third case in this video is about an untenured teacher’s termination of employment.
