A common misconception is that divorcing clients can freely update their trust once a case is filed. Another common misconception is that the ATRO is a freeze ray that does not allow a client to make any financial moves at all.
ATROs limit what can be done, particularly when it comes to funding or transferring assets. Planning can and should move forward, but only with careful coordination with the divorce lawyer and compliance with court orders.
When estate planning is done thoughtfully, it prevents missteps and protects the integrity of the divorce process.
