What is an executor, and why is this role vital in your estate plan? An executor is the person you choose to carry out the terms of your will after you pass away. This individual has a legal obligation to ensure your wishes, as outlined in your will, are fulfilled.
When the time comes, your executor will go to probate court to open an estate case in the county where you passed away or where your assets are located. The court will then oversee the executor as they manage your estate, ensuring everything is done according to the terms of your will. This could include distributing assets to beneficiaries, paying off debts, and handling other responsibilities you've entrusted them with.
The role of an executor is a significant responsibility, as they must act in accordance with your wishes and submit necessary reports to the court. Choosing someone you trust is essential because they will be legally bound to carry out your instructions.
