🔹 1. Designated Authority — A Major Change
The Bill proposes a concept of Designated Authority -means Government authority that will control FCRA money and Assets.
🔹2. What Happens to FCRA-Funded Assets?
Where the prescribed circumstances arise, foreign contribution and assets created from such contribution may vest provisionally with the Designated Authority. The Authority may take possession, maintain records, inspect assets and accounts, manage assets where required in public interest, transfer assets to a government department/local authority, or sell assets and deposit the proceeds into the Consolidated Fund of India, as applicable.
🔹 3. Special Protection for Places of Worship 🛕🕌⛪
For assets such as a temple, mosque, church, gurdwara or other place of worship, the Designated Authority is required to ensure that the religious character of the place is maintained.
🔹4. Key Functionaries — Wider Responsibility
Responsibility is proposed to extend beyond directors/officers to key functionaries, including persons such as trustees, partners, office bearers, managing committee members or persons who actually control the organisation.
🔹 5. Investigation Safeguard
Investigation cannot be initiated without the prior approval of the Central Government,
🔹 6. Penalty Changes ⚖️
Imprisonment reduced from up to 5 years to up to 1 year, while the possibility of a fine.
