Shalom. Today I wanted to discuss how to obtain citizenship in Israel and the various methods that exist in order to obtain citizenship in Israel. As you may know from watching previous videos and reading our articles, Israel is a Jewish and democratic state.
The Jewish aspect of Israel is mainly defined by the law of return and by the fact that Israel aspires to have a Jewish majority. The law of return which was enacted in 1950 basically grants automatic citizenship to anyone who is defined as a Jew, if he has a Jewish mother or if he is a convert to Judaism through one of the recognized religious denominations in Judaism, which is the Orthodox denomination. The conservative denomination and the reform denomination, if the conversion is done through one of these recognized streams, then a person is also defined as a Jew and can immigrate to Israel.
The definition also stipulates that a Jew that believes in a different religion like Islam or Christianity is excluded from being able to immigrate to Israel. In addition there is a family members clause in the law of return, and the family member clause applies to someone that is a child of a Jew or a grandchild of a Jew or the spouse of a child of a Jew or the spouse of a grandchild of a Jew. All these family members of Jews that I mentioned can also immigrate and receive automatic citizenship in Israel.
In addition to the law of return, there is an additional law that exists that allows people to obtain Israeli citizenship, even if they are not Jewish. This law is a law of citizenship, which was enacted in 1952. Section 4 to the law of citizenship basically grants automatic citizenship to anyone who is born to a parent who was an Israeli citizen, regardless if this parent was Jewish or not, and regardless of where this child was born. The reason for this is because Israel doesn't apply an area jurisdiction of granting citizenship like many other countries, where if you're born in the jurisdiction of that country, you become a citizen in Israel. If you are born in the jurisdiction of the state of Israel and you’re not a Jew and your parent is not an Israeli citizen, you basically have no status.
Many situations arise whereby children are born, and they have no status at all. That's why the state of Israel throughout the years enacted special government decisions to grant status to children of foreign workers, for example, who grew up here and went to school here and became part of the Israeli system and have permanent residency. However, this is an irrelevant law when it comes to granting citizenship.
If your father is an Israeli citizen and not, for example, after 1967 when Israel decided to include and to annex various areas that were captured as part of Israel such as East Jerusalem, then Israel decided to grant to all the residents of these annexed areas permanent residency status. Therefore all these permanent residents now are able to apply for Israeli citizenship. Another problematic clause is the fact that they need to renounce their other citizenship, and that might be a problem to permanent residents that hold citizenship in countries that are considered valuable citizenship, such as European countries or American citizenship.
Our office has assisted many people throughout the years in obtaining citizenship according to section 4 of the law of citizenship, particularly via paternity lawsuits that we submitted in order to prove that the child really has an Israeli father. We assisted many permanent residents in obtaining citizenship through section 5 vie naturalization, which included renouncing the other citizenship and sometimes even submitting complaints to the public complaints commission or even a petition to the Supreme Court. We have many successful results in this area.
