IRS Spouse Back Taxes-Filing Jointly When One Spouse Owes Back Taxes-If My Spouse Owes Back Taxes

Hey everyone, welcome back to the HoustonTax YouTube channel! If you're new here, make sure to subscribe and hit that notification bell so you stay updated with all our latest tax tips and tricks.

Today, we’re tackling a topic that can be a bit tricky—what happens if one spouse owes back taxes and you’re filing jointly? We’ll break down what you need to know to navigate this situation smoothly.

Let’s get into it!

So, you’ve got a situation where one spouse owes back taxes and you’re wondering how this impacts your joint tax filing.

Here’s the deal: when you file jointly, both you and your spouse are responsible for the entire tax liability. This means that if your spouse has back taxes owed, you might also be on the hook for those amounts.
But don’t panic! There are steps you can take to protect yourself and manage the situation effectively. Let’s break down your options.

Option one is Innocent Spouse Relief: If you didn’t know about the back taxes and didn’t benefit from them, you might qualify for Innocent Spouse Relief. This relief can help you avoid being held responsible for the tax debt that’s solely the other spouse’s responsibility.

Option two is Separation of Liability Relief: This option is for those who are no longer married or are legally separated. It allows you to divide the tax liability so you’re only responsible for your share of the debt.

The last and third option is Equitable Relief: If neither of the above options apply, you might qualify for Equitable Relief, which considers whether it would be fair to hold you responsible for the tax debt.

Here’s the catch: to apply for any of these relief options, you need to fill out Form 8857, the Request for Innocent Spouse Relief. It’s important to provide all the necessary details and documentation to support your claim.
