In this video, we explore the concept of premeditation in the context of first-degree murder under common law. Historically, courts inferred premeditation from near spontaneous acts, suggesting it could occur in a moment. Today, however, the courts require that there be some opportunity for reflection by a reasonable person before premeditation can be established.
We also discuss how premeditation does not necessarily imply malice. For example, a mercy killing or euthanasia, even if premeditated, can result in a conviction for first-degree murder.
