Hi I'm Tom DeBenedetto of Thomas DeBenedetto & Associates Workers' Compensation Attorneys in San Diego, California. I want to talk to you a little bit about Death Benefits. Death benefits in California have been around for at least 50 years.

Unfortunately, the benefit has not been updated or increased in at least 20 years. Currently you're entitled to a $10,000 burial expense and if you have multiple dependents you can receive up to $320,000.

The question is how do you qualify for death benefits?

Your death must be caused by the work injury or contributed to by the work injury in some respect as little as 1%. So if you have sustained an injury on the job and you have an admitted injury and ultimately you succumb to that injury you should be covered.

There is however a timeframe. If your injury results in your death after 5 years you will no longer be covered. So the injury and the death must occur within 5 years from the date of injury.

Hopefully in the future our governor will increase the death benefit because it is incredibly low and unfair at this point in time.
