Warning of imposing hefty penalties on telecom companies, the Supreme Court refused to hear arguments for reassessment of pending AGR (Adjusted Gross Revenue) dues by telecom companies. Refusing to accept the 20 year payment timeline being proposed by telecom companies, the court has reserved its order on whether it will allow staggered payment of pending AGR dues.
Expressing its ire on attempts by telecom companies to renegotiate pending dues and "wriggle out of liabilities", the court ordered that it won't allow telecom companies to play a "2nd inning" of litigation by delaying payments any further. Though Vodafone Idea and Bharti Airtel scaled down their demand from 20 years to 15 years as the timeline for AGR payments, the court asked them to come up with a "reasonable" schedule, citing its duty as custodian of the country's revenue.
While telecom companies disputed AGR liability being claimed by DoT, Justice Arun Mishra led bench questioned why any relief should be given to "dishonest" telecom companies who were still contesting pending dues, making it clear that anyone trying to tamper with the past year verdict will be sent behind bars.
