Many investors are being investors are being made to believe that buying land with old Certificates of Occupancy—some issued in the 1990s—would soon expire, once the 99 years granted run out, and the government will automatically take back the land. This fear has caused many rushing to sell before the expiration date.
Here’s the truth: A Certificate of Occupancy does NOT expire like a tenancy agreement.
Under the Land Use Act, a Right of Occupancy subsists until it is lawfully revoked, not simply because the stated years have elapsed. There is no Nigerian court decision where land was taken back solely because the C of O “expired.”
🚨 Government can only revoke land by due process, such as:
• Overriding public interest (roads, rail, public infrastructure) with notice & compensation
• Breach of allocation conditions
• Illegal or defective allocation
• Fraud or misrepresentation
