Meaning of Interpleader Suit
The word “interpleader” means “between parties.”
An Interpleader Suit is filed by a person who does not claim any right himself, but two or more other persons are fighting over the same thing that he possesses.
So, the person holding the property or money says to the court:
“I don’t know who the real owner is. Please decide between them, and I will hand it over to the rightful person.”
Example (Simple Explanation)
Let’s take an easy example:
A is a tenant of a shop.
After the landlord B dies, B’s two sons, X and Y, both claim to be the new owner of the shop and start demanding rent from A.
A doesn’t know to whom he should pay rent — to X or to Y.
👉 So, A files an Interpleader Suit in court under Order 35 CPC, saying:
“I am ready to pay the rent, but please decide who the real owner is. Once decided, I’ll pay that person.”
This way, A protects himself from paying the rent twice or getting sued by both sides.
