Gyanesh Kumar’s resignation is being demanded by CJP and Opposition parties — but can the Chief Election Commissioner simply be removed?
No.The CEC holds a constitutionally protected position, and removing the Chief Election Commissioner is very different from removing a minister.
So, what does the Constitution actually say?
From a Parliamentary removal motion and an inquiry into allegations of proved misbehaviour or incapacity, to the special majority required in both Houses of Parliament, the process has several steps. And only after Parliament passes the required address can the President issue the removal order.
Meanwhile, the Supreme Court has now issued notice to the Centre, the Election Commission and Gyanesh Kumar over allegations concerning the functioning of the poll panel, while declining to suspend him at this stage.
So, resignation is a demand. Removal is a constitutional process. What do you think — should citizens be more concerned about who holds the post, or how independently the Election Commission functions?
