In this session, Mr. Sandeep Khatri, expert faculty at Drishti Judiciary, explains an important Supreme Court judgment highlighting the role of appellate courts while reviewing trial court decisions and the limits of making adverse remarks against judicial officers.
The Supreme Court Bench set aside the Kerala High Court's direction requiring a Principal Sub Judge to undergo training after criticism of the trial court's handling of a will dispute. The Court held that appellate courts should function as a friend, philosopher and guide to subordinate courts rather than adopting a punitive approach. It also reiterated that a first appellate court must independently reappreciate facts and evidence, assign cogent reasons while reversing trial court findings, and exercise restraint before making adverse observations affecting the reputation and independence of judicial officers. The matter has been remanded to the Kerala High Court for fresh consideration on merits.
