Former Lamu Senator Anwar Charged Over Alleged Forged Logbook as Lawyers testify

Описание: A former Lamu senator, Anwar Loitiptip, was on Tuesday placed at the centre of an alleged forged motor vehicle logbook transaction after two advocates, Maina and Daniel Muliro, testified before the Milimani Law Courts.
The matter was heard on 10 February 2026 before Senior Principal Magistrate P.K. Mutai.
Testifying as the first prosecution witness, Maina, an advocate who previously worked at Anwar’s office at Kilimani LEC Plaza, told the court that the accused called him on 3 August 2022 and instructed him to prepare sale agreements for a Toyota Land Cruiser registration number KDA 005C.
“ He told me he wanted to sell his vehicle and asked me to originate the sale agreements and share them on WhatsApp so that they could be forwarded to the buyer, ” Maina testified.
He told the court that Anwar directed him to a house in Kileleshwa, where he found the accused already present together with the buyer, Samson Mutina Malonza, and another person whose identity he could not recall.
“At the house, Anwar was there, together with Samson Mutina Malonza and another person,” Maina told the court.
According to Maina, the parties read and agreed on the contents of the sale agreements before signing.
“I acted for both parties. I stamped and signed the agreement,” he testified.
Maina further told the court that Sh3 million in cash was handed over by the buyer to Anwar at the meeting, out of an agreed purchase price of Sh6 million.
“The balance was to be paid the same day and that is when the vehicle would be released,” he said.
He testified that a motor vehicle registration certificate bearing serial number K4250950P was presented during the transaction and indicated that Anwar was the registered owner. The logbook, he said, showed it had been issued on 25 August 2017.
Maina said he later received a call from a police officer identified as Kibei, asking him to report to Kilimani Police Station because he had signed the transaction documents.
“I was informed that the logbook that had been issued was a fake logbook,” he testified.
The second prosecution witness, advocate Daniel Muliro, told the court that he acted for Ramna International Motors, the motor vehicle dealer that sold the same vehicle to Anwar under a hire purchase arrangement.
He testified that a sale agreement dated 29 August 2020 showed that Ramna sold a Toyota Land Cruiser V8, 2012 model, chassis number JTMHV091904091004, to Anwar for Sh10 million.
“The buyer paid Sh3.5 million as a deposit and the balance of Sh6.5 million was to be paid in monthly instalments,” Muliro told the court.
He said that Ramna later informed him that Anwar disappeared immediately after paying the deposit.
According to Muliro, investigations by the company revealed that the vehicle’s tracker had been tampered with and that a motor vehicle search showed the car had already been transferred to Anwar.
“That transfer was impossible because technically the company was still the owner of the vehicle since the full purchase price had not been paid,” he testified.
Muliro told the court that a logbook for the vehicle was issued on 9 October 2020, but an NTSA search still reflected Ramna International Motors as the registered owner.
He also produced a letter dated 29 December 2019 from the Directorate of Criminal Investigations addressed to the Kenya Revenue Authority confirming that the vehicle was not listed as stolen at the time of purchase.
When asked by the defence how the vehicle reverted to the company, Muliro said: “I cannot comment on the reversion because I am not aware how it happened.”
The defence challenged the two witnesses, arguing that their testimony was based on instructions and information received from third parties.
Anwar, who served as Lamu Senator between 2017 and 2022, is facing two counts. In the first count, he is accused of making a false motor vehicle registration certificate for motor vehicle KDA 005C on 3 August 2022, at an unknown place within the country, without lawful authority.
In the second count, he is accused of fraudulently uttering a forged motor vehicle registration certificate to Samson Mutina Malonza on the same date and place.
The case will be mentioned for further hearing on 26 March 2026.
