Court of Appeal allows Malaysian Bar to challenge Zahid's DNAA decision

Описание: The Court of Appeal today allowed the Malaysian Bar’s bid to challenge the Attorney‑General’s decision that led to a discharge not amounting to an acquittal, or DNAA, for Datuk Seri Dr Ahmad Zahid Hamidi in his Yayasan Akalbudi corruption trial.

A three‑member bench led by Datuk Faizah Jamaludin ruled the Bar’s judicial review application was not frivolous, raising serious public law issues that warrant a full hearing at the High Court.

The judges noted Zahid’s trial had reached an advanced stage, with 99 prosecution witnesses and 15 defence witnesses already testifying, and a prima facie case established on all 47 charges.

The court stressed the Bar was not attacking the DNAA order itself, but the Attorney‑General’s decision to discontinue prosecution and seek the DNAA.

The matter will now return to the High Court for a substantive hearing.
