The Supreme Court on March 17, 2026, ruled that Section 60(4) of the Social Security Code, 2020, which restricted maternity benefits to adoptive mothers only if the adopted child is under 3 months of age, is unconstitutional. The Court declared that adoptive mothers are entitled to 12 weeks of maternity leave, regardless of the child's age. This judgment brings attention to the need for equal treatment of adoptive mothers and challenges the existing age-based distinction.
In this video, we explore the Supreme Court's landmark decision, the constitutional implications, and the legal framework that governs maternity benefits for adoptive mothers. The Court also urged the Union Government to introduce paternal leave as a social security benefit for both parents.
