If you’re preparing a 2255 motion, one of the biggest mistakes you can make is filing without the full record.
In this video, Board-Certified Criminal Law and Criminal Appeals Specialist Jacob Blizzard walks through the essential documents you need to properly pursue a federal 2255 writ . That includes obtaining your trial attorney’s complete file - discovery, motions, notes, time records, and internal documentation - which can reveal what was done in your case and, just as importantly, what wasn’t.
You’ll also learn how to access court records through PACER (https://pacer.uscourts.gov/) , how to obtain transcripts (including plea or sentencing transcripts if they were never created), and why sealed documents often require going back to defense counsel . In addition, requesting the prosecutor’s file through a Freedom of Information Act (FOIA) request can uncover information that may not have been disclosed - sometimes forming the basis for Brady claims.
This process can feel overwhelming, especially when communication may have broken down during your case and you’re left trying to piece together what actually happened. But clarity starts with documentation. Understanding the full record gives you the foundation to identify constitutional errors and build a meaningful challenge.
If you or your loved one is considering a 2255 motion, take the time to gather the records first. Preparation matters - and having the right documents can make all the difference.
