In this probation-revocation hearing, Dalius Williams appeared with defense attorney Mr. Rojos while prosecutor Mr. Smith represented the state. The court addressed a second amended motion alleging multiple violations, including failure to report, unpaid fees, and a new allegation connected to evading arrest, alongside the shadow of a pending injury-to-a-child case.
Williams reaffirmed his earlier pleas of true to failing to report and to being behind on court costs. However, he changed his plea to not true on the evading charge. Because witnesses were present, the judge proceeded with evidence on another count and ultimately ruled that the state had met its lower burden required in a revocation hearing.
The judge carefully explained the stakes. A prior four-year concurrent offer covering both this case and the pending charge was rejected. Prosecutors warned that if Williams later lost at trial, they would ask the court to stack any future sentence on top of whatever punishment resulted today. After confirming he understood, Williams chose to move forward.
During arguments, the defense asked for continued probation or, if revoked, a lighter term of two to four years. The state pointed to Williams’s lengthy record, repeated revocations, and recent allegations involving harm to a child, arguing probation had consistently failed.
The probation officer agreed with the prosecution. The judge expressed deep concern about a pattern of behavior around children and found revocation appropriate. Williams was sentenced to eight years in prison, with credit for time served, and informed of firearm restrictions and limited appeal rights.
