From 1 July 2027, the 50% capital gains tax discount on Australian property and shares is being replaced by an inflation-based indexation method, a system Australia phased out in 1999. Tim is in Melbourne with Tristan Perry to unpack what has actually changed since budget night, and what the capital gains tax change means for expats holding assets back home.

In this episode:
→ Negative gearing isn't gone. Properties held on budget night are grandfathered. For established property bought after that, losses from 1 July 2027 can only offset property income, such as rent or capital gains, not your salary.
→ New builds keep the benefits, including knock-down rebuilds that add dwellings and, in Tristan's view, new granny flats.
→ Why non-residents never had the 50% discount anyway, and why they miss out on indexation while overseas.
→ The capital gains tax change that spooked expats: the original wording that could have locked out anyone who'd ever lived abroad, and the proposed fix for returning residents. That fix is still draft; Tristan expects it to pass.
→ Do you need a property valuation now? Tristan says no. Retrospective valuations are standard practice, and the ATO has flagged more than one method.
→ The main residence exemption and six-year rule are unchanged, but you must be an Australian tax resident when you sell.
→ Family trusts: a 30% non-refundable minimum tax on distributions from 1 July 2028, why bucket company strategies take a hit, and a proposed fixed-entitlement option.
→ Division 296 tax on super balances over $3 million, and the end of SMSF limited recourse borrowing for residential property.

If you're an Aussie expat with property, shares or a trust in Australia, this is your plain-English guide to the capital gains tax change and everything around it.

Recorded late September 2026. Some changes are draft legislation and may shift. This is general information, not tax advice. Speak to a qualified adviser about your situation.
