The Supreme Court has strongly criticised the Uttar Pradesh Criminal Law Amendment Act, 2023, which abates all pending Motor Vehicles Act cases — including non-compoundable offences like drunk driving, drugged driving, and jumping red lights.
A bench of Justices J.B. Pardiwala and K.V. Viswanathan warned that this amendment could have a drastic impact on road safety by removing the deterrent effect of traffic laws. The Court questioned how offenders under Section 185 (drunk driving) can be allowed to walk free and rejected the State’s defence that IPC charges would compensate.
The Supreme Court has now sought affidavits from UP’s Legal and Transport Departments explaining the amendment and its consequences.
