Описание: The proportionality test is used by the High Court of Australia to characterise the purposive heads of power in the Australian Constitution. It is also used to assess the constitutional rights and freedoms expressed and implied in the Constitution. In this video, we will focus on the first: the relationship between proportionality and constitutional characterisation. We will look at what proportionality means, what it is composed of, and how the Court has used the proportionality test in some constitutional cases.
