CC&Rs outline the rules and property use restrictions within the community. Some examples of CC&Rs include parking restrictions, rental restrictions, or rules with pets.
Bylaws are the guidelines for how the HOA governs itself. They define voting rights of homeowners and board members, how and when board and annual meetings must be held, and the rules for board member elections, terms, and officer roles.
The article of incorporation is the HOA’s license to operate. It’s filed with the Secretary of State by the property developer’s attorney during the community’s formation.
Architectural Guidelines ensure a consistent appearance throughout the neighborhood. Examples of architectural guidelines include approved yard decorations and restrictions on structural changes or additions. If homeowners want to make significant changes to their property, they must submit an application including plans, materials, and paint colors for the HOA board or architectural committee to review.
These documents work together to establish rules, responsibilities, and operational procedures that ensure a well-maintained and harmonious community. Understanding these documents is essential for each HOA board member.
