Does the Privileges or Immunities Clause of the Fourteenth Amendment still matter? Professor Christopher Green argues that it still plays an important role in the chain of Constitutional Law cases heard by the Supreme Court over the last century. Although it has not been officially invoked since the Slaugherhouse cases, subsequent cases have relied on reasoning that can be traced back to Justice Bradley’s opinions in 1873 and 1884.
Christopher Green is Professor of Law and Jamie L. Whitten Chair in Law and Government at the University of Mississippi School of Law.
