In this vlog, Caitlin Jenkins, the familylawvlogger and her colleague, Alison Bull, talk about a recent surrogacy case in which Alison, our colleague Rose-Marie Drury and counsel Tom Harrill of St Ives Chambers acted for the surrogate mother. This case pushed the boundaries of purposive interpretation of the Human Fertilisation and Embryology Act 2008 to ensure its compatibility with human rights law, and most importantly to ensure that the child’s relationship with his parents was given legal recognition by the making of a parental order, as well as enabling the surrogate mother to cease being a legal parent. Surrogacy law is a very technical and regulated area, which is expected to be reformed in the next 2 or 3 years and this vlog will bring you right up to date on the latest judgement, handed down today 24 June 2020.
