During the proceeding, the judge reviewed an updated Pre-Sentence Investigation (PSI) report and prior admissions. Ms. Butcher had already pleaded true to several probation violations, including failure to report, leaving a court-approved rehabilitation program without authorization, and engaging in new criminal conduct while on supervision. The defense argued that outstanding warrants contributed to her departure from treatment and stated her intention to return for rehabilitation. It was also noted that she was six months pregnant, had a young child, and struggled with substance abuse while attempting to rebuild stability and pursue a healthcare career.
The court, however, highlighted inconsistencies in her explanations, repeated violations of probation conditions, continued drug use during pregnancy, new felony arrests, and disciplinary issues while incarcerated. The judge expressed concern regarding credibility, personal responsibility, and the broader impact on her children and public safety.
After considering arguments from counsel, the probation department, and the defendant’s statements, the court determined that Ms. Butcher’s pleas were made knowingly and voluntarily. The judge found sufficient evidence to adjudicate guilt in cause number 24-DCCR-1732, formally convicting her of burglary of a habitation and sentencing her to 10 years in the Institutional Division of the Texas Department of Criminal Justice, resulting in full probation revocation.
