A typical private equity investment would cause affiliation, and ruin a company’s small business status, because the private equity investor often insists on rights that give it (in SBA’s view) too much control over the business. SBICs, however, are exempt from SBA’s affiliation rules. In that way, SBICs are a real game-changer for private equity investments in small business contractors.
